Manufacturers, importers and distributors selling into New Hampshire have until January 1, 2027 to confirm that covered consumer products contain no intentionally added PFAS. Under RSA 149-M:64, as amended by HB 167, the ban applies to nine categories: carpets and rugs, cosmetics, textile treatments, feminine hygiene products, food packaging and containers, juvenile products for children under 12, upholstered furniture, textile furnishings, and waxes for boats, skis and boards. New Hampshire defines PFAS using the federal TSCA structural definition, which is narrower than the definitions used in Maine and Minnesota, so products need scoping state by state. NHDES can request a Certificate of Compliance at any time, with 30 days to respond, and exempt products still need a certificate stating the basis of the exemption. Exemptions cover products with at least 85% recycled content, products made before the ban, and replacement parts.
